Legal Disclaimer

1. General Liability Limitation

NextDay Drop GmbH shall not be held liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of our services, including but not limited to loss of profits, revenue, data, or business opportunities. Our total aggregate liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific shipment in question. Clients acknowledge that they use our services at their own risk and that our liability is limited to the extent permitted by German law.

2. Force Majeure

NextDay Drop shall not be liable for any delay, failure, or disruption of service resulting from circumstances beyond our reasonable control. This includes, but is not limited to: natural disasters, acts of war or terrorism, pandemics, government restrictions or sanctions, airline cancellations or rerouting, port closures, strikes or labour disputes, severe weather conditions, civil unrest, or any other event constituting force majeure under German law. In the event of force majeure, delivery timelines shall be extended accordingly, and NextDay Drop shall make all reasonable efforts to resume service as soon as practicable.

3. Pet Transport Liability

While NextDay Drop takes all reasonable measures to ensure the safety and well-being of animals during transport, we cannot guarantee outcomes that depend on the health, temperament, or pre-existing conditions of the animal. NextDay Drop shall not be held liable for: (a) veterinary conditions that arise during transport that are not caused by negligence on our part; (b) behavioural responses of the animal to the transport environment; (c) non-compliance by the client with pre-transport veterinary requirements; (d) refusal of entry by destination country authorities due to incomplete or incorrect documentation provided by the client. Clients are required to provide accurate health records and to follow all pre-transport instructions issued by NextDay Drop.

4. Temperature Embargo Clause

NextDay Drop reserves the right to suspend, delay, or refuse pet and temperature-sensitive shipments during periods of extreme weather. Temperature embargoes are imposed by airlines and transport authorities to protect the health and safety of live animals and perishable goods. Embargoes may apply when ground temperatures at origin, transit, or destination airports fall below 7°C (45°F) or exceed 29°C (85°F). NextDay Drop is not responsible for delays caused by temperature embargoes and will work with clients to reschedule affected shipments at the earliest available opportunity.

5. Customs Clearance Responsibility

The client is solely responsible for providing accurate and complete customs documentation for international shipments. NextDay Drop assists with customs preparation as a convenience, but does not guarantee the acceptance, clearance, or processing time of any customs authority. NextDay Drop shall not be held liable for: (a) customs duties, taxes, or import fees imposed by destination authorities; (b) delays caused by customs inspection or additional documentation requests; (c) confiscation or destruction of goods by customs authorities; (d) fines or penalties resulting from inaccurate or incomplete declarations made by the client. Clients must ensure compliance with all applicable import and export regulations of both origin and destination countries.

6. Insurance Limitation

Insurance coverage, when purchased, is subject to the specific terms and conditions of the selected insurance plan. Coverage limits, exclusions, and claim procedures are detailed in the insurance policy documentation provided at the time of purchase. NextDay Drop acts as an intermediary for insurance services and is not the direct insurer. Claims are processed by our insurance partners and are subject to their standard review and verification procedures. Coverage does not extend to: items not declared at the time of booking; items undervalued in the shipment declaration; prohibited or restricted goods; pre-existing damage not documented prior to shipment; or losses resulting from improper packaging by the client.

7. Governing Law

These terms and all legal relationships between NextDay Drop GmbH and its clients shall be governed by the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes is Frankfurt am Main, Germany, unless otherwise required by mandatory consumer protection laws.
